Neulich habe ich etwas gefuddelt, als ich andeutete, ich hätte den Text Text MILITANT DEMOCRACY AND FUNDAMENTAL RIGHTS von Karl Löwenstein gelesen – ulay, was leesen! In Wahrheit habe ich nur die ersten Seiten des ersten Teils wirklich gelesen habe. Mittlerweile konnte ich noch weiter lesen. Da mir dabei noch mehr Textstellen auffielen, die ich für bemerkenswert halte, sammele ich hier die Zitate, die mir beim weiteren Lesen auffallen. Außerdem versehe ich die Auszüge mit kurzen Gedanken:

The main principle of democracy is the notion of legality. Fascism therefore officially annexed legality. Since experience acquired in other countries does not commend the coup d’etat for the immediate conquest of the state, power is sought on the basisof studious legality. If possible, access is obtained to national and communal representative bodies. This purpose is facilitated by thatgravest mistake of the democratic ideology, proportional representation. Democracies are legally bound to allow the emergence andrise of anti-parliamentarian and anti-democratic parties under thecondition that they conform outwardly to the principles of legalityand free play of public opinion. It is the exaggerated formalism of the rule of law which under the enchantment of formal equalitydoes not see fit to exclude from the game parties that deny the veryexistence of its rules.

(Vielleicht ist es wegen der Ordnungsliebe in der deutschen Gesellschaft deswegen so schwer, rechtsextreme Parteien zu verbieten. Vielleicht auch, weil die Rechtsprechung sich beim Parteienverbot in eine argumentative Sackgasse manövriert hat: NPD zu klein, AfD zu groß.)

Thus fascism forces itself into the foreground, where its emotional spell can be cast upon the masses. Its technique is relentless self-advertisement and propaganda. Democracy could not reckon with the effects of open propaganda. While vigilance was focussed, in fatal misunderstanding of the changed technique of revolutionary movements, on secret actions, no legislative devices existed for offsetting revolutionary emotionalism in the garb of legality, propaganda, and military symbolism. Fascism shrewdly capitalized this situation and won its most notablevictories by boring into the weakness of the democratic system.

(Die Überzeugung, die Demokratie sei stärker von revolutiknären Akteuren im Untergrund bedroht, als von jenen, die offen agieren, spiegelt sich im Umgang mit Linksextremismus wieder. Insbesondere die Gleichsetzung der Bedrohung, die vor allem von Konservativen betrieben wird,acht das deutlich. – Vielleicht rührt diese hufeisenartige Gleichsetzung von links und rechts von einem für die Realität blind machenden Harmoniebedürfnis.)
